IMPORTANT: BY USING YOUR CoveSkin™ LED MASK, YOU AGREE TO BE BOUND BY THE TERMS OF THE ONE (1) YEAR HIGH DOSE LIMITED WARRANTY (“WARRANTY”) AS SET FORTH BELOW.

DO NOT USE YOUR PRODUCT UNTIL YOU HAVE READ THE TERMS OF THE WARRANTY. IF YOU DO NOT AGREE TO THE TERMS OF THE WARRANTY, DO NOT USE THE PRODUCT AND RETURN IT WITHIN THE RETURN TIME LISTED IN THE CoveSkin™ RETURN POLICY FOR A REFUND.

HOW CONSUMER LAW RELATES TO THIS GUARANTEE

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS WHICH VARY FROM COUNTRY TO COUNTRY (OR STATE OR PROVINCE). OTHER THAN AS PERMITTED BY LAW, CoveSkin™ DOES NOT EXCLUDE, LIMIT OR SUSPEND OTHER RIGHTS YOU MAY HAVE, INCLUDING THOSE WHICH MAY ARISE FROM NON-COMPLIANCE WITH A SALES CONTRACT. FOR A FULL UNDERSTANDING OF YOUR RIGHTS, YOU SHOULD CONSULT THE LAWS OF YOUR COUNTRY, PROVINCE OR STATE.

WARRANTY LIMITATIONS SUBJECT TO CONSUMER LAW

TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES STATED ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. CoveSkin™ DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. TO THE EXTENT SUCH WARRANTIES CANNOT BE EXCLUDED, CoveSkin™ LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT CoveSkin™'S OPTION, THE REPAIR OR REPLACEMENT SERVICES DESCRIBED BELOW. SOME COUNTRIES (STATES AND PROVINCES) DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY (OR CONDITION) LASTS, SO THE LIMITATION DESCRIBED ABOVE MAY NOT APPLY TO YOU.

WHAT IS COVERED BY THIS WARRANTY?

CoveSkin™ warrants the CoveSkin™ branded LED mask and CoveSkin™ branded accessories contained in the original packaging (“CoveSkin™ Led Mask”) to be free from defects in materials and workmanship when used normally in accordance with published guidelines by CoveSkin™ for a period of ONE (1) YEAR from the date of original retail purchase by the end user purchaser (“Warranty Period”). Guidelines published by CoveSkin™ include, but are not limited to, information contained in technical specifications, user manuals and service communications.

WHAT IS NOT COVERED BY THIS WARRANTY?

This warranty does not apply to non-CoveSkin™ branded products, even if packaged or sold with CoveSkin™ branded products. CoveSkin™ does not guarantee that the operation of the CoveSkin™ LED mask will be uninterrupted or error-free. CoveSkin™ is not responsible for any damage resulting from failure to follow the instructions for using the CoveSkin™ LED mask.

This warranty does not apply to: (a) cosmetic damage, including but not limited to scratches, dents, and broken plastic on ports, cords, or controllers, unless the failure is due to a defect in materials or manufacturing; (b) damage caused by accident, abuse, misuse, fire, contact with liquid, earthquake or other external cause; (c) damage caused by use of the CoveSkin™ LED mask outside of CoveSkin™ published guidelines; (d) damages caused by service performed by anyone who is not a representative of CoveSkin™; (e) to a CoveSkin™ LED mask that has been modified to alter functionality or capability without the written permission of CoveSkin™; (f) defects caused by normal wear and tear or otherwise due to normal aging of the CoveSkin™ LED mask; or (g) if CoveSkin™ receives information from relevant public authorities that the Product has been stolen and you cannot in any way prove that you are the authorized user of the Product (e.g. by presenting proof of purchase).

YOUR RESPONSIBILITIES

Before receiving warranty service, CoveSkin™ or its agents may require that you provide proof of purchase details, answer questions designed to help diagnose potential problems, and follow CoveSkin™'s procedures for obtaining warranty service .

After warranty service, your CoveSkin™ LED mask or a replacement item will be returned to you, subject to updates and availability of the applicable product model.

Important: Do not attempt to repair the CoveSkin™ LED mask, controller, or any other aspect of the CoveSkin™ product. Attempting to repair the CoveSkin™ product is dangerous and may cause damage that is not covered by this warranty. Only CoveSkin™ should perform product maintenance.

NO COMMERCIAL USE

All CoveSkin™ brand consumer products, including LED masks, are designed and intended for home use only. CoveSkin™ branded consumer products are not intended for use in a commercial or institutional setting or application. These include, but are not limited to: commercial gyms, commercial spas, wellness centers, chiropractors' offices, doctors' offices, any other medical establishments, churches, police/fire departments , government agencies, apartment/retirement/condominium communities, hotels, cruise ships, schools or universities

Use of any CoveSkin™ brand product in a commercial or institutional setting will void the product warranty and may expose the property owner to unnecessary risk.

WHAT WILL CoveSkin™ DO IF THE WARRANTY IS BREACHED?

If during the warranty period you submit a claim to CoveSkin™ pursuant to this warranty, CoveSkin™, at its discretion:

• repair the CoveSkin™ LED mask using new or previously used parts that are equivalent to new in terms of performance and reliability,
• Replace the controller,
• replace the CoveSkin™ LED mask with the same model (or with your consent, a product with similar functionality) formed from new and/or previously used parts that are equivalent to new parts in terms of performance and reliability, or
• exchange the CoveSkin™ LED mask for a new item.

HOW TO OBTAIN WARRANTY SERVICE?

You must contact CoveSkin™ by email at contact@coveskin.com in order to request warranty service. A CoveSkin™ representative will help you determine if your CoveSkin™ LED mask requires maintenance and, if so, advise you on how CoveSkin™ will provide it.

WARRANTY SERVICE OPTIONS

CoveSkin™ will provide warranty service by postal mail. If CoveSkin™ determines that your CoveSkin™ LED Mask is eligible for postal service, CoveSkin™ will send you prepaid shipping invoices and instructions on how to properly package and address your CoveSkin™ LED Mask, so that you can ship your CoveSkin™ LED mask to CoveSkin™. . Instructions will be sent to you by email. Once the service is completed, CoveSkin™ will return the product to you. CoveSkin™ will pay shipping costs to and from your location if all instructions regarding the method of packaging and shipping the CoveSkin™ LED Mask are followed.

CoveSkin™ reserves the right to change the method by which CoveSkin™ can provide warranty service to you, as well as the eligibility of your CoveSkin™ LED Mask to receive a particular method of service. The service will be limited to the options available in the country where the service is requested. Service options, parts availability and response times may vary by country. You may be responsible for shipping and handling charges if the CoveSkin™ LED mask cannot be repaired in the country in which it is located. If you seek service in a country that is not the country of origin of purchase, you will comply with all applicable import and export requirements. laws and regulations and be responsible for all customs duties, VAT and other associated taxes and fees. Where international service is available, CoveSkin™ can repair or replace the CoveSkin™ LED mask and its parts with comparable products and parts that meet local standards.

LIMITATION OF LIABILITY

EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, CoveSkin™ IS NOT LIABLE FOR ANY DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO USEFUL LOSS; LOSS OF INCOME; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF USE OF MONEY; LOSS OF PLANNED SAVINGS; BUSINESS LOSS; LOSS OF OPPORTUNITY; LOSS OF GOOD WILL; LOSS OF REPUTATION; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE WHATSOEVER, INCLUDING REPLACEMENT OF EQUIPMENT AND PROPERTY.

THE FOREGOING LIMITATION DOES NOT APPLY TO CLAIMS FOR DEATH OR PERSONAL INJURY, OR TO ANY LEGAL LIABILITY FOR INTENTIONAL AND SERIOUS ACTS AND/OR OMISSIONS.

SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

GENERAL

No reseller, agent or employee of CoveSkin™ is authorized to make any modification, extension or addition to this warranty. If any term is found to be illegal or unenforceable, the legality or enforceability of the remaining terms will not be affected or impaired. This warranty is governed by and construed in accordance with the laws of the country in which the purchase of the CoveSkin™ LED mask took place. CoveSkin™ or its successor in title is the guarantor of this warranty.
